1. Scope and provider
These Terms of Sale apply to all purchases on laravel-nova-examples.com. The seller is Bär Softwareentwicklung UG (haftungsbeschränkt), Bolongarostraße 101H, 65929 Frankfurt am Main, Germany, registered at Amtsgericht Frankfurt am Main under HRB 129017, email anthony.baer@baer-software.com, phone +49 160 8599799 ("we"). The contract language is English. Deviating terms of the buyer do not apply.
2. Products
We sell digital content that is provided online, not on a physical medium:
- Single project: the complete walkthrough of one demo project on this website and the project's source code as a ZIP download, including later versions of that project for as long as we offer it.
- All projects (lifetime): the same for every project published on this website, including projects published later, for as long as we operate the website. If we discontinue the website, we will announce it at least 90 days in advance so that you can download all source code you have access to.
The projects are built on Laravel Nova, a commercial product of Laravel Holdings Inc. that is not part of the products. Using the source code requires your own valid Laravel Nova license. Signing in requires a GitHub account.
3. Conclusion of the contract
The presentation of products on the website is not a binding offer. You select a product, sign in with GitHub, accept these terms, confirm the immediate provision of the content and are then forwarded to our payment provider Stripe. There you can review and correct your details. By clicking the payment button you submit a binding offer. The contract is concluded when we accept the offer by confirming the order by email or by giving you access to the content, whichever happens first. We store the contract text; you receive these terms and the withdrawal information with the order confirmation.
4. Prices and payment
Prices are in US dollars and include VAT where it applies. Payment is processed by Stripe Payments Europe, Ltd. using the payment methods offered during checkout. You receive an invoice by email and in your account.
5. Provision of the content
You get access immediately after the payment has been confirmed: the walkthrough is unlocked on the project page and the ZIP can be downloaded from the project page and your account.
6. Licence
You receive a non-exclusive, non-transferable, perpetual and worldwide right to use, modify and integrate the source code into any number of your own applications and applications you build for your clients. You may not redistribute, sell or publish the source code, the walkthroughs or substantial parts of them as they are or as a template, starter kit, course or collection of examples, and you may not share your download or account with others. If a purchase is refunded or withdrawn, the licence ends and you must delete the source code.
7. Right of withdrawal
Consumers have a right of withdrawal as described in the withdrawal information. For digital content it expires early when we begin providing the content after you have expressly agreed to this and acknowledged that you lose your right of withdrawal, and we have confirmed the contract to you.
8. Warranty
The statutory warranty rights apply. The source code is provided as demonstration code; check it before using it in production.
9. Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the Product Liability Act and in case of a guarantee. In case of slight negligence we are only liable for the breach of essential contractual obligations (obligations whose fulfilment makes the proper performance of the contract possible in the first place and on which you may regularly rely), limited to the damage typical for the contract and foreseeable at the time of conclusion. Otherwise liability is excluded.
10. Account
You can delete your account at any time in your account settings. Deleting the account ends your access to purchased content; download the source code beforehand. We keep order records as long as the law requires.
11. Dispute resolution and applicable law
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board. German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law does not deprive them of the protection of the mandatory provisions of the law of the country in which they have their habitual residence.
